BeyondWhiskers Wholesale & White-Label Program Terms

These terms govern all business-to-business wholesale purchases and white-label services provided by BeyondWhiskers.

By applying for, purchasing through, or participating in the BeyondWhiskers Wholesale or White-Label Program, the Buyer agrees to these terms.

Relationship Between Wholesale & White Label

The BeyondWhiskers White-Label Program is an additional service offered as part of our business-to-business wholesale program.

All white-label customers are subject to the applicable BeyondWhiskers Wholesale Program Terms in addition to the additional White-Label Terms contained on this page.

A white-label purchase does not create a partnership, franchise, agency, distributorship, affiliate relationship, joint venture, or other business relationship beyond the purchase and sale of products and agreed white-label services.

Wholesale Purchases

Wholesale customers purchase BeyondWhiskers products for resale through their own independent businesses.

Wholesale customers are responsible for their own:

• Customers

• Retailers

• Stores

• Sales channels

• Customer service

• Retail pricing

• Advertising

• Marketing

• Returns

• Refunds

• Replacements

• Reviews

• Storage

• Handling

• Distribution

• Business licenses

• Registrations

• Taxes

• Resale activities

BeyondWhiskers does not operate or manage the wholesale customer's business after the business-to-business sale.

White-Label Purchases

White-label customers receive products prepared for resale under the customer's own independent brand.

When a Buyer purchases a white-label product, the Buyer assumes responsibility for the operation of that private-label brand and all ordinary post-sale commercial activities associated with it.

The Buyer is responsible for its:

• Brand

• Label artwork

• Retail customers

• Consumers

• Stores

• Distributors

• Customer complaints

• Refunds

• Returns

• Replacements

• Reviews

• Customer service

• Retailer service

• Marketing

• Advertising

• Product listings

• Retail pricing

• Storage

• Warehousing

• Distribution

• Fulfillment

• Applicable registrations and licensing

Consumers and retailers purchasing the Buyer's white-label products are customers of the Buyer, not customers of BeyondWhiskers.

BeyondWhiskers' Limited Role

For wholesale transactions, BeyondWhiskers' role is limited to the business-to-business sale and fulfillment of products.

For white-label transactions, BeyondWhiskers' role is limited to the business-to-business sale, preparation, packaging, labeling, and fulfillment of the products and services purchased by the Buyer.

BeyondWhiskers does not become the Buyer's:

• Customer-service provider

• Retail partner

• Sales representative

• Distributor to the Buyer's customers

• Marketing company

• Retailer

• Business partner

• Affiliate

• Franchise

• Agent

Except for responsibilities that applicable law specifically requires BeyondWhiskers to retain, all ordinary retail and customer-facing responsibilities belong to the Buyer.

Which Terms Apply

Wholesale Order:
The Wholesale Program Terms apply.

White-Label Order:
The Wholesale Program Terms and the additional White-Label Program Terms apply.

If an order contains both regular wholesale products and white-label products, all applicable provisions of these terms apply to the respective products and services.

Order-specific pricing, products, quantities, flavors, shipping charges, destinations, and other transaction details will be stated separately on the applicable invoice, quote, or order confirmation.
