Subscriptions
When you purchase a subscription, you'll receive repeat deliveries. These are based on the subscription duration and frequency that you select.
Your payment details will be stored securely, and you'll be charged for each of these deliveries unless you choose to pay in advance.
Some subscriptions may auto-renew at the end of their duration. If you don't want to renew a subscription, you can cancel it.
If you want to cancel or change your subscription, you can do it at any time. Your order confirmation emails have links to your order. You can manage your subscription from there.

Pre-orders
When you purchase a pre-order, you are buying an out-of-stock or soon-to-be-available product not yet in inventory. We may collect no payment or a partial deposit at checkout, store your payment method, then fulfill and charge the full or remaining payment at a future date.

BEYONDWHISKERS WHITE LABEL AGREEMENT, RELEASE OF LIABILITY, HOLD HARMLESS, AND TERMS OF SALE

Effective Date: May 12, 2026

LEGALLY BINDING AGREEMENT

By purchasing, receiving, possessing, repackaging, labeling, marketing, distributing, or reselling any products supplied by BeyondWhiskers, the purchaser ("Customer") agrees to be legally bound by this Agreement.

If Customer does not agree to these terms, Customer must not purchase, possess, use, distribute, or resell any products supplied by BeyondWhiskers.

1. INDEPENDENT BUSINESS RELATIONSHIP

Customer acknowledges and agrees that BeyondWhiskers is solely a supplier of products.

Customer is an independent business entity and is not affiliated with, endorsed by, sponsored by, represented by, employed by, partnered with, or acting on behalf of BeyondWhiskers in any capacity.

Customer shall not represent, advertise, imply, or state that BeyondWhiskers is responsible for Customer's business operations, product labeling, packaging, branding, marketing, advertising, warranties, customer service, or resale activities.

Nothing contained herein creates a partnership, joint venture, agency relationship, franchise relationship, employment relationship, or business affiliation between BeyondWhiskers and Customer.

2. WHITE LABEL PRODUCTS

BeyondWhiskers may offer select products for private label or white-label resale.

Customer acknowledges that BeyondWhiskers does not provide:

• Custom manufacturing
• Custom formulations
• Custom recipes
• Ingredient substitutions
• Product development services
• Veterinary advice
• Legal advice
• Regulatory compliance services

Products are sold only in the condition supplied.

3. TRANSFER OF OWNERSHIP, RISK, AND RESPONSIBILITY

Ownership, risk of loss, responsibility, and liability transfer to Customer immediately upon delivery to the shipping carrier or delivery location.

Once products leave the possession or control of BeyondWhiskers, BeyondWhiskers has no control over and assumes no responsibility for:

• Storage conditions
• Warehousing
• Transportation
• Repackaging
• Relabeling
• Inventory management
• Product rotation
• Product contamination
• Product deterioration
• Marketing claims
• Distribution
• Resale activities
• Customer service

Customer assumes all responsibility for products after transfer of ownership.

4. CUSTOMER LICENSING, REGISTRATION, PERMITS, AND COMPLIANCE

Customer is solely responsible for determining, obtaining, maintaining, and complying with all licenses, permits, registrations, certifications, insurance requirements, approvals, and legal obligations required by any federal, state, county, municipal, tribal, or international authority.

Customer is solely responsible for:

• Business licenses
• Sales tax permits
• Resale certificates
• State registrations
• Product registrations
• Feed registrations where required
• Pet product registrations where required
• Packaging compliance
• Label compliance
• Advertising compliance
• Marketing compliance
• Tax compliance
• Any other applicable legal or regulatory requirements

BeyondWhiskers does not guarantee that Customer is authorized to sell products in any jurisdiction and assumes no responsibility for Customer's compliance with any law or regulation.

5. CUSTOMER LABELING AND MARKETING RESPONSIBILITY

Customer is solely responsible for all:

• Labels
• Packaging
• Branding
• Marketing materials
• Product descriptions
• Health claims
• Nutritional claims
• Advertising
• Marketplace listings
• Website content
• Social media content

BeyondWhiskers does not review, approve, verify, or guarantee the legality or accuracy of Customer-created content.

6. ASSUMPTION OF RISK

Customer acknowledges that pet treats, foods, chews, supplements, and similar products involve inherent risks.

Customer voluntarily assumes all risks associated with:

• Storage
• Handling
• Transportation
• Distribution
• Marketing
• Sale
• Resale
• Feeding
• Consumption
• Use of products supplied by BeyondWhiskers

7. PET INJURY, ILLNESS, OR DEATH

Customer acknowledges that animals may react differently to ingredients, foods, treats, environmental conditions, feeding practices, allergens, sensitivities, and other factors.

To the fullest extent permitted by law, BeyondWhiskers shall not be responsible for:

• Veterinary expenses
• Injury to animals
• Illness
• Allergic reactions
• Digestive upset
• Choking incidents
• Adverse health events
• Property damage
• Death of any animal

occurring after products have left the possession or control of BeyondWhiskers.

Customer acknowledges that BeyondWhiskers cannot control storage conditions, handling practices, repackaging procedures, labeling practices, or resale activities after shipment.

8. RELEASE OF LIABILITY

To the fullest extent permitted by law, Customer releases BeyondWhiskers, its owners, officers, employees, contractors, agents, successors, and assigns from any and all claims, liabilities, demands, damages, losses, costs, expenses, penalties, judgments, settlements, and causes of action arising from or related to:

• Product storage
• Product handling
• Product transportation
• Product repackaging
• Product labeling
• Product marketing
• Product distribution
• Product resale
• Product consumption
• Product use

9. INDEMNIFICATION AND HOLD HARMLESS

Customer agrees to defend, indemnify, and hold harmless BeyondWhiskers, its owners, officers, employees, contractors, agents, successors, and assigns from and against any and all claims, lawsuits, liabilities, damages, losses, penalties, fines, judgments, settlements, costs, expenses, and attorney fees arising from or related to:

• Customer's business operations
• Product storage
• Product handling
• Product repackaging
• Product relabeling
• Product marketing
• Product resale
• Regulatory violations
• Licensing violations
• Labeling violations
• Customer negligence
• Third-party claims
• Claims involving pet injury, illness, or death

This obligation survives termination of the business relationship.

10. DISCLAIMER OF WARRANTIES

Except as expressly required by law, all products are sold "AS IS" and "AS AVAILABLE."

BeyondWhiskers disclaims all warranties, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Suitability for Customer's intended use

No statement made by BeyondWhiskers shall create any warranty not expressly stated herein.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BeyondWhiskers shall not be liable for:

• Indirect damages
• Consequential damages
• Incidental damages
• Special damages
• Exemplary damages
• Punitive damages
• Lost profits
• Lost revenue
• Business interruption
• Loss of goodwill

Customer agrees that any liability of BeyondWhiskers shall be limited to the amount paid by Customer for the specific product giving rise to the claim.

12. PRICING ERRORS AND ORDER CORRECTIONS

BeyondWhiskers reserves the right to correct any typographical, clerical, technical, software, website, marketplace, promotional, inventory, or pricing error at any time.

BeyondWhiskers may:

• Refuse an order
• Cancel an order
• Correct pricing
• Limit quantities
• Issue a refund
• Request approval of a corrected price

BeyondWhiskers shall not be obligated to honor pricing errors regardless of whether payment has been received.

A refund of amounts paid shall be Customer's sole remedy for an affected order.

13. PRODUCT AVAILABILITY

Product availability is not guaranteed.

BeyondWhiskers reserves the right to discontinue, substitute, modify, limit, or remove products from sale at any time without notice.

14. FORCE MAJEURE

BeyondWhiskers shall not be liable for delays, shortages, failures, or inability to perform caused by events beyond its reasonable control, including but not limited to:

• Hurricanes
• Floods
• Fires
• Natural disasters
• Supplier shortages
• Carrier delays
• Government actions
• Labor disputes
• Power outages
• Internet outages
• Acts of God

15. NO REFUNDS OR RETURNS

Due to the nature of pet food and pet treat products, all sales are final unless otherwise required by law.

16. CHARGEBACKS

Customer agrees to contact BeyondWhiskers and provide a reasonable opportunity to resolve any dispute before initiating a chargeback, payment reversal, or payment dispute.

17. ATTORNEY FEES

In any dispute arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorney fees, costs, and expenses to the fullest extent permitted by law.

18. GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Florida.

Any dispute arising from or related to this Agreement shall be brought exclusively in a court of competent jurisdiction located within the State of Florida.

19. ELECTRONIC ACCEPTANCE

Customer agrees that acceptance of this Agreement may occur electronically through:

• Website checkbox acceptance
• Online account registration
• Electronic signature
• Purchase order submission
• Payment submission
• Product receipt
• Product possession
• Product resale

Such acceptance shall have the same legal force and effect as a handwritten signature.

20. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between BeyondWhiskers and Customer regarding white-label purchases and supersedes all prior discussions, communications, representations, or agreements.

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

CUSTOMER ACKNOWLEDGMENT

BY PLACING AN ORDER, MAKING PAYMENT, ACCEPTING DELIVERY, POSSESSING, REPACKAGING, LABELING, MARKETING, DISTRIBUTING, OR RESELLING PRODUCTS SUPPLIED BY BEYONDWHISKERS, CUSTOMER ACKNOWLEDGES THAT CUSTOMER HAS READ, UNDERSTOOD, AND AGREES TO BE LEGALLY BOUND BY THIS AGREEMENT.
